GENERAL CONDITIONS OF SALE ONLINE

Article 1: Purpose

The present general conditions of sale aim to define the rights and obligations of Galerie V and the Customer of products presented by Galerie V on its site www.galeriev.fr (hereinafter "the Site"). They apply exclusively to V & V Magniant, SARL with capital of € 7622.45 registered under the unique number 319803565 RCS PARIS, whose registered office is located at 39-41 galerie Vivienne 75002 Paris, France (hereinafter "Galerie V ") and any individual consumer visiting or making a purchase via said Site (hereinafter" the Customer ").

On the Site, Galerie V allows the Customer to order on-line furniture and decorative objects (hereinafter "the Product (s)") according to the present general conditions.

Any order made with Galerie V implies acceptance by the Customer without reservation of the present conditions. These General Terms and Conditions may be modified at any time and without prior notice by Gallery V, with the applicable conditions being those in effect at the date of the order by the Customer.

Article 2: Products and Compliance

2.1. The products offered for sale are presented on the site of Gallery V and include a description.

2.2. The Products offered by Galerie V comply with the standards applicable in France.

The elements such as photographs, texts, graphics and all the information and characteristics illustrating and / or accompanying the Products are not contractual, which the Customer acknowledges.

The Customer shall have a description for each Product containing the essential characteristics of the product concerned.

 

Article 3: Obligations of the Customer

3.1. The Client declares to be at least 18 years old and have the legal capacity or to have a parental authorization enabling him to place an order on the Site.

3.2. The Customer undertakes to communicate to Galerie V the actual and necessary information required for the realization of the service subject to these conditions as requested online and according to his situation, including his name, first name, address, telephone number and valid e-mail.

The Customer is responsible for the consequences arising from information transmitted false or inaccurate or whose takeover would be unlawful.

3.3. Once the order has been placed, Galerie V will send the Customer an e-mail confirming the order. He informs him of the dispatch of the Products.

3.4. The Customer may modify his data in the "My Account" section.

 

Article 4: Price, availability and delivery

4.1. The prices displayed on the Site are indicated in euros, all French taxes included (French VAT and other applicable taxes), excluding postage, participation in order processing costs and packaging costs.

The shipping costs, participation in order processing costs and packaging costs will be indicated in the Customer's basket before the final validation of the order.

Products delivered to countries outside the European Union are not subject to VAT.

Prices are subject to change at any time due to promotions or sales.

The cost of the telecommunications transmissions induced by the conclusion and / or execution of the present shall remain the responsibility of the Customer.

4.2. Galerie V reserves the right to cancel or refuse an order in case of dispute with the Customer on a previous order.

4.3. In case of temporary unavailability of a Product, Galerie V will inform the Customer of the delays of the suppliers and / or manufacturers of the Product concerned. The Customer may also subscribe to an e-mail alert in order to receive an e-mail once the Product will be available again. He reserves the right to propose to the Customer in replacement an article of a quality and an equivalent price. In this case, the expenses of returns following the possible exercise of the right of retraction will be charged to Galerie V. In the event that Galerie V can not provide the Customer with an item of quality and equivalent price, the customer does not wish this article of quality and equivalent price, the Customer can cancel his order.

In case of permanent unavailability, if Gallery V could not provide the Customer with an item of quality and equivalent price, his order will be canceled automatically.

4.4. To buy one of the Products, the Customer can click on his graphic representation. This product is added to its shopping cart containing, if applicable, other items that the Customer wishes to acquire and previously placed in his shopping basket. The Client expressly declares to have all the necessary authorizations for the use of the method of payment when validating his order. He also undertakes to ensure his solvency before any order, fault for Gallery V to be able to proceed with the delivery of the Products ordered. In the event of insolvency, Galerie V also reserves the right to suspend or cancel any order or delivery in the event of non-payment or cancellation of payment.

4.5. Galerie V delivers its products in Metropolitan France, including Corsica, Germany, Australia, Austria, Belgium, Brazil, Canada, China, Cyprus, South Korea, Denmark, Spain, Estonia, the United States, Finland, Great Britain, Guadeloupe, French Guiana, Ireland, Iceland, Israel, Italy, Japan, Laos, Luxembourg, Malta, Martinique, Mayotte, Mexico, Monaco, Norway, New Caledonia, New Zealand, the Netherlands, French Polynesia, Portugal, Reunion, Saint Pierre and Miquelon, Singapore, Slovenia, Sweden , Switzerland, Taiwan and Thailand.

Products are shipped with the delivery note to the delivery address indicated by the Customer when ordering. Delivery can not be made in hotels or mailboxes.

4.6. In order to comply with these deadlines, the Client must ensure that he has provided accurate and complete information concerning the delivery address (such as: street, building, staircase, access codes , names and / or intercom numbers, etc.).

Galerie V can not be held responsible for the consequences due to delay in forwarding if Galerie V provides proof that the non-performance or poor performance of the contract is attributable either to the Client or to the unpredictable and insurmountable fact of a third party to the contract , or to a case of force majeure.

In case of damaged packages (already open, missing products ...), the Customer agrees to notify Gallery V, by any means, any reserves within 3 days of receipt of the product.

 

Article 5: Payment

Payment is secure. Gallery V will never be in possession of the bank details of its Customers. It can be done by credit card, Paypal or check.

To pay by check, the Client must send his check to the following address:

Galerie V will be able to validate and send the order only from the receipt of the check.

Cards issued by banks domiciled outside France must be international bank cards. In case of payment by credit card, the amount of the order is debited at the time of the order on the site. The order is paid in one go. The simple fact of providing the credit card number entails authorization to debit the account of the Customer up to the amount of the order.

 

Article 6: Customs duties

Any order placed on the Site and delivered outside France may be subject to any taxes and customs duties that are imposed when the parcel reaches its destination. These customs duties and any taxes related to the delivery of a Product are at the Customer's expense and are the responsibility of the Customer. Galerie V is not required to verify and inform the Customer of the applicable customs duties and taxes. To know them, Galerie V advises the Client to ask the competent authorities of his country.

 

Article 7: Returns of Product (s) - right of withdrawal

The Customer has a period of 14 clear days to exercise its right of withdrawal from receipt of products.

Without prejudice to the legal right of withdrawal, within fourteen (14) days of receipt of the order, the Customer may request from Galerie V the return or exchange of the Product (s) s).

 

In order to facilitate processing, the Client may first make a request for return or exchange on the site in the space "my account", or by e-mail or telephone. If the return request is validated by Gallery V, Gallery V will then send an e-mail explaining the return procedure.

Return is at the Client's risk. Galerie V suggests to the Customer to make the return of his products by registered mail or provided with additional insurance, guaranteeing him, if necessary, compensation of the products at their actual market value in case of spoliation or loss of that merchandise. It will be up to the Customer to retain any proof of return. The return costs are the responsibility of the Customer, who is free to choose the method of shipping.

In the event of an error attributable to Galerie V (defective article or order preparation error), Galerie V pays the return costs of the article. The Customer shall transmit the carrier's invoice to Gallery V for compensation.

If the item is not returned by the Customer within one week after receipt of the return authorization email, the return is considered canceled and the Customer must retain the product.The returned Product will be refunded within a maximum of fifteen (15) days from receipt by Galerie V. The refund does not include return shipping costs. If the Customer has chosen a refund, the amount to be refunded will be credited to the Customer's bank account via the payment method used at the time of the order: credit card, paypal or check. If the Customer has chosen an asset, Gallery V will send it by e-mail a voucher for the return amount. If the Customer has chosen an exchange, Galerie V will send the item to him / her in exchange (Gallery V will bear the exchange shipping costs). The exchanges are valid only for the changes of sizes of the same reference. No other type of exchange will be accepted.

Personalized products will not be returned or exchanged.

Article 8: Newsletters

Any person registered on the Site may subscribe to the newsletters of Galerie V. The registrant will receive on average one e-mail per month and can at any time unsubscribe via the unsubscribe link on the newsletter or by sending an email to the address contact@galeriev.fr

Article 9: Retention of title

The Products remain the property of Galerie V until full payment of the price by the Customer.

In the absence of a full payment made within a maximum period of 15 calendar days from the date of delivery, the Client is obliged to return the goods at his own expense and the contract shall be deemed to be terminated upon receipt by Galerie V property restored in good condition.

Article 10: Guarantees and liability

Galerie V is not liable for any inconvenience or damage inherent in the use of the Internet, including breach of service, external intrusion or the presence of computer viruses, or any act known as force majeure, in accordance with law and jurisprudenceArticle 11: Intellectual Property

In no event will the Client be authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, blog articles ...).

This Site or any part of this Site may in no circumstances be reproduced, copied, sold or exploited for commercial reasons without the express written permission of Galerie V.

In general, all copyrights, trademarks and other distinctive signs and proprietary or intellectual property rights appearing on the Site will remain the full property of Galerie V or its partners / suppliers.

The Customer is therefore obliged to respect the intellectual property rights and will not be able to use the trademarks appearing on the Site and the Products if any, or to file a trademark which would prejudice the owner of the rights, unless otherwise stipulated in the contract.

The same applies to any other intellectual property right.

 

Article 11: Intellectual Property

In no event will the Client be authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, blog articles ...).

This Site or any part of this Site may in no circumstances be reproduced, copied, sold or exploited for commercial reasons without the express written permission of Galerie V.

Article 12: Protection of personal data

Galerie V agrees to use the confidential information of the Clients only in the context of the exploitation of its Site.

 

Article 13: Force majeure

In the event of an event of force majeure, the party concerned must inform the other party within fifteen (15) days of the occurrence of the event by registered letter with acknowledgment of receipt.

Expressly, cases of force majeure or unforeseeable circumstances are considered to be the cases usually taken up by the jurisprudence of French courts and tribunals. All obligations of the parties shall be suspended throughout the duration of the event of force majeure without compensation.

If the event of force majeure lasts for more than three (3) months, the contract concerned may be terminated ipso jure without compensation for either party.

 

Article 14: General provisions

14.1. Partial validity of clause

If any of the stipulations of the present conditions is declared null or void by a competent court, it will be declared unwritten and will not invalidate the other stipulations.

14.2. Update

These general terms and conditions can be modified at any time and without notice by Gallery V, the conditions applicable being those in effect at the date of the order by the Customer.

14.4. : Reproduction of the applicable texts (Ordinance 2005-136 of 17 February 2005, Consumer Code, Civil Code)

Art. L. 211-4. of the Consumer Code

The seller is obliged to deliver goods conforming to the contract and is liable for any defects in conformity existing at the time of issue.
